‘Company’ refers to SD Maintenance and Build who act as a finding agent for contractors.
‘Client’ refers to the individual or entity engaging the Company for services.
‘Services’ means the property maintenance, repair, or building work to be performed as specified in the service agreement or estimate.
‘Contract’ refers to the agreement between the Company or assigned contractor and the Client, including the quotation and these Terms and Conditions.
Scope of Work
The services provided will be outlined in a written quotation or service agreement. Any additional work outside that scope will require a separate agreement and may incur additional charges.
Quotation and Payment
The Company shall provide a written estimate or quotation prior to the commencement of work.
The Client agrees to pay the agreed fees in accordance with the payment schedule outlined in the contract.
Payment is due upon receipt of the invoice or as stated in the contract.
Late payment may incur interest.
Scheduling and Completion
The Company will endeavour to commence and complete the work within the agreed timeframe.
Delays caused by unforeseen circumstances, access issues, or client failure to provide necessary information, may result in schedule adjustments.
Access, Site Conditions and Permissions
The Client shall ensure the Company has safe and unrestricted access to the site during agreed working hours.
The Client shall inform the Company of any hazards or restrictions on site.
The Client is responsible for obtaining and necessary permissions, permits or approvals required for the works.
Materials and Equipment
The Contractor shall supply all necessary materials, tools and equipment unless otherwise specified.
The Client shall be responsible for providing any access or utilities required for the work.
Changes to scope of works
Any changes to the scope of the work must be agreed upon in writing and may affect the cost and timeline.
Additional works will be billed separately.
Health and Safety
The Company shall comply with all applicable health and safety laws and regulations.
The Client shall cooperate and ensure the safety of personnel on site.
Warranties and Guarantees
The Company warrants that the work will be performed to a professional standard.
Warranties for materials and workmanship are subject to the manufacturer’s terms and conditions.
Liability
The Company shall not be liable for any indirect or consequential damages.
The Company’s total liability shall not exceed the total amount paid by the Client for the work.
Cancellation and Termination
The client may cancel the contract in writing before work commences, subject to any cancellation fees.
The Company reserves the right to cancel the contract if the client breaches terms and conditions or endangers health and safety.
Insurance
The Company maintains appropriate insurance coverage for its operations, including Public Liability Insurance.
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the work.
Entire Agreement
The Service Agreement, quotation and these Terms and Conditions constitute the entire agreement between the parties.
Amendments
Any amendments to these Terms and Conditions must be made in writing and signed by both parties.
